Acceptance of Terms

By accessing or using Finca Metrics (the "Service"), operated at fincametrics.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

Finca Metrics helps small businesses track sales, manage their team, scan receipts, figure out costs, and run reports.

Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Each person may maintain only one account. You agree to notify us immediately of any unauthorized access to or use of your account.

Subscription and Payment

A free tier is available with limited features. Paid plans are billed monthly or annually at your selection. Prices are subject to change with at least 30 days advance notice. All fees are stated and charged in United States dollars (USD). No refunds are provided for partial billing periods unless required by applicable law.

License Grant

Subject to these terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You may not sublicense, resell, or distribute access to the Service to any third party.

Your Data

You retain ownership of all data you input into Finca Metrics. You grant us a limited license to process, store, and display your data solely for the purpose of providing and improving the Service. Upon account termination, you may export your data within 30 days. After that period, we may delete your data in accordance with our data retention policies.

Refunds & Money-Back Guarantee

Every paid plan includes a money-back guarantee window. Request a refund in that window and we will refund in full.

Acceptable Use

You agree that you will not: use the Service for any illegal or unauthorized purpose; attempt to gain unauthorized access to any part of the Service or its related systems; interfere with or disrupt the operation of the Service; upload malicious content including viruses, malware, or harmful code; scrape, crawl, or reverse-engineer the platform or its underlying technology; or share your account credentials with unauthorized users.

AI Features

Receipt scanning and other AI-powered features use third-party AI services to process your records. AI-generated results are provided on an "as-is" basis and should be reviewed for accuracy before being relied upon. You are responsible for verifying all AI-processed records, including scanned receipt totals, categorization, and extracted line items.

Intellectual Property

Finca Metrics, its logo, design, and underlying code are the property of KrisCodes2 LLC. All rights reserved. You may not copy, modify, or create derivative works of the platform without prior written consent from KrisCodes2 LLC.

Service Availability

We target 99.9% uptime but do not guarantee uninterrupted or error-free service. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by third-party services, including but not limited to AWS, Clover POS, or internet service providers.

Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of KrisCodes2 LLC arising out of or related to these terms or the Service shall not exceed the aggregate amount you paid to us in the twelve (12) months preceding the claim. In no event shall KrisCodes2 LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, records, or business opportunities.

Disclaimer of Warranties

The service is provided "as is". We do not guarantee that reports will be free of errors — they depend on the integrity of the records we import.

Indemnification

You agree to indemnify, defend, and hold harmless KrisCodes2 LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases immediately. You may export your records for up to 30 days following termination. After that period, your records may be permanently deleted.

Dispute Resolution

Any disputes arising out of or relating to these terms or the Service shall be resolved through binding arbitration in the Commonwealth of Puerto Rico, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law principles.

Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated via email to registered users at least 30 days in advance. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated terms.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and KrisCodes2 LLC regarding your use of the Service and supersede all prior agreements and understandings.
